These terms and conditions apply to all sales concluded with the establishment «Bastide de Ganay», 1 chemin de Ganay 13540 Puyricard, (with the exception of group bookings). Consequently, the customer acknowledges having read these general terms and conditions of sale and undertakes to comply with them. These terms of sale may be modified at any time, and the applicable terms will be those in effect on the date the reservation is made.
ARTICLE 1 – PRICING
The indicated rates are in Euros and inclusive of all taxes, taking into account the VAT applicable on the day of the reservation. Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically reflected in the prices indicated on the invoice date.
Rates are per room for the number of people indicated and according to the selected period, and do not include services (unless otherwise stated)
The tourist tax of 1.10 € per day and per person (over 12 years old), increased by 10% by the municipality, making it 1.20 €, is not included in the displayed price and must be paid directly on site. It applies from January 1 to December 31 of each year.
Some services may be subject to an extra charge and potential modifications without notice, for which the establishment shall not be held liable under any circumstances.
No stay booked prior to the introduction of any promotional offer will be eligible for a refund, even a partial one.
ARTICLE 2 – RESERVATIONS AND MEANS OF PAYMENT
The reservation will only be effective if it is guaranteed by the client, either by providing a credit card number with an expiration date or by paying a deposit, and upon receipt of a detailed reservation confirmation.
Payment for all services is to be made directly to the hotel 7 days prior to arrival (with the exception of reservations prepaid at the time of booking).
The establishment reserves the right to refuse any reservation in the event that the credit card number is incorrect or the reservation is incomplete.
All bookings, regardless of their origin, are payable in euros only.
The «Bastide de Ganay» establishment accepts the following credit cards: Visa, Mastercard, and has a secure reservation system (SSL) that protects and encrypts all sensitive data transmitted during booking to prevent any disclosure to a third party.
When booking the reservation, a credit card debit authorization will be processed. This is done for informational purposes only and will not result in a charge to the account under any circumstances, except in the following cases:
- Non-cancellable, non-refundable promotional offer
- If the credit card expiration date is prior to the arrival date.
- If the arrival date is more than 89 days from the booking date.
The customer is solely responsible for their choice of services and their suitability for their needs, such that the «Bastide de Ganay» establishment cannot be held liable in this regard.
ARTICLE 3 – FORCE MAJEURE
Force majeure is defined as any external event beyond the control of the parties that is both unforeseeable and insurmountable, which prevents the customer from fulfilling all or part of the obligations set out in the contract during the trip. This shall apply in particular in the event of hotel staff strikes, or government or public riots. Transport strikes shall not be considered as force majeure.
ARTICLE 4 – MODIFICATION AND CANCELLATION OF STAY
Any modification or cancellation of a reservation must be requested by email at bastideganay@gmail.com or by phone at 06 20 82 49 86.
The request will only become effective once the «Bastide de Ganay» establishment has confirmed its acceptance in writing.
In the event of a modification or cancellation of the stay, the following conditions apply (except in cases of force majeure):
- For any request made less than 28 days before the scheduled arrival date, the total amount of the reservation will be charged to you.
- In case of a no-show on the scheduled arrival date, your credit card will be charged the total amount of the reservation.
- Any begun stay is entirely due.
For reservations made via our partners« website, cancellation must be made through that site. The applicable cancellation conditions are therefore specific to the partner and may thus differ from those of the »Bastide de Ganay" establishment.»
In the event of a stay extension, the guest must notify the hotel reception by 10:00 AM at the latest on the scheduled day of departure in order to check availability.
ARTICLE 5 – THE HOTEL AND SERVICES
For security and hygiene reasons, pets are not allowed on the premises.
Rooms are available from 3:00 PM and must be vacated by 11:00 AM on the day of departure. An extra charge may apply for failure to comply with the latest departure time. For arrivals after 8:00 PM, the reception must be notified.
The customer accepts and undertakes to use the room as a prudent and diligent guest. Furthermore, any behavior contrary to good morals and public order will lead the «Bastide de Ganay» establishment to ask the customer to leave the establishment without any compensation and/or without any refund if a payment has already been made.
ARTICLE 6 – RELOCATION
In the event that the «Bastide de Ganay» establishment is unavailable, or in cases of force majeure, the latter reserves the right to accommodate the client, fully or partially, in a hotel of equivalent or higher category offering services of the same nature. The transfer will then be at the expense of the «Bastide de Ganay» establishment, which cannot be held liable for the payment of any additional compensation.
ARTICLE 7 – CLAIMS
Any complaint must be sent to the «Bastide de Ganay» establishment by registered letter with acknowledgment of receipt, within 15 days following the departure from the stay that is the subject of the said complaint. After this period, no complaint can be accepted.
ARTICLE 8 – DATA PRIVACY AND FREEDOM OF INFORMATION
Pursuant to Law 78-17, known as the Data Protection Act, customers are advised that their reservation is subject to computerized personal data processing. Users have the right to access and rectify the data entered, which may be exercised by contacting the head office: «Bastide de Ganay», 1 chemin de Ganay 13540 Puyricard. Please note that this information is not shared with third parties.
The «Bastide de Ganay» offers Wi-Fi internet access. The user client agrees that the IT resources made available to them shall not be used in any way for the purpose of reproduction, representation, making available, or communication to the public of works or objects protected by copyright or related rights, such as texts, photographic images, audiovisual musical works, software, and video games, without the authorization of the rights holders provided for in Books I and II of the Intellectual Property Code when such authorization is required.
The «Bastide de Ganay» has a video surveillance system in the common areas of the building as well as in the parking lot.
ARTICLE 9 – RESPONSIBILITIES
The Bastide de Ganay declines all responsibility in the event of theft, loss, or damage to effects belonging to guests during their stay.
The client will be held responsible for any damage, deterioration, or act of vandalism that may occur as a result of the occupancy of the premises and/or due to the participants and/or staff under their responsibility, whether to movable property, decoration, and real estate belonging to the hotel or not. Consequently, the «Bastide de Ganay» may therefore ask the client to leave the establishment without any compensation and without any refund for the ongoing stay, and to reimburse the damage caused by these acts.
GOVERNING LAW
These General Conditions of Sale are governed by French law. This applies to both substantive and procedural rules. Disputes shall fall under the exclusive jurisdiction of the French courts.
